A CHARTERED ORDINANCE EXEMPTING THE CITY OF MILTONVALE, KANSAS FROM THE PROVISIONS OF SECTION 12-4112 OF THE KANSAS STATUTES ANNOTATED AS ADOPTED BY THE KANSAS LEGISLATURE AND AMENDMENTS THERETO; AND PROVIDING ADDITIONAL PROVISIONS OF THE SAME SUBJECT AUTHORIZING AND SETIING THE ASSESSMENTS OF THE COURT COSTS IN CASES HEARD IN THE MUNICIPAL COURT OF THE CITY OF MILTONVALE, KANSAS.
Section 1. The City of Miltonvale, Kansas, a city of the third class, by virtue of the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt and does exempt itself from, and makes it inapplicable to the Section 12-4110 and Section 12-4112 of the Kansas Statutes Annotated as adopted by the Kansas Legislature and amendments thereto, which are not uniformly applicable to all cities, the legislature having make special provisions applying to certain classes of cities in said amendment.
Section 2. In lieu of K.S.A. 12-4112, the governing body of the City of Miltonvale, Kansas, hereby adopts the following provisions:
(a) Every person found guilty of a violation of the ordinances of the City of Miltonvale, Kansas, shall be assessed costs for the administration of justice in the municipal court of the City of Miltonvale, Kansas, and such costs shall be determined by charter ordinance, until amended, modified, or rescinded by further ordinances.
