A CHARTER ORDINANCE EXEMPTING THE CITY OF MILTONVALE FROM THE PROVISIONS OF K.S.A. 12-4112, RELATING TO COURT COSTS, AMENDING SECTION 2, PARAGRAPH B OF CHARTER ORDINANCE NO. 6, PASSED BY THE CITY OF MILTONVALE ON JULY 16, 1982, AND PROVIDING FOR GOVERNANCE OF MUNICIPAL COURT COSTS BY CITY CODE.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MILTONVALE;

SECTION 1. THE CITY OF MILTONVALE, BY VIRTUE OF THE POWER VESTED IN IT BY ARTICLE 12, SECTION 5 OF THE CONSTITUTION OF THE STATE OF KANSAS, hereby amends Charter Ordinance 6, Section 2, paragraph (b), with the following:

(b)   Court Costs: in lieu of the provisions of Kansas Statutes Annotated 12-4112, the City of Miltonvale, Kansas, further adopts the following court costs: In all municipal court cases where the accused person, or persons as the case may be, plead guilty or nolo contendere, or is found guilty, such person shall be assessed costs and assessments as required by Kansas State Statutes and as further set by Ordinance made by the Governing Body of the City of Miltonvale, Kansas, for the administration of justice in the municipal court of Miltonvale, and in addition thereto, the municipal judge of the City of Miltonvale is authorized and empowered to assess witness fees and mileage permitted and allowed pursuant to K.S.A. 12-4411.
